Thank you in advance

As is written here (https://www.elxis.org/elxis-4-and-elxis-20093-comparison.html) at the Important notes says clearly that "You can not update Elxis 2009.x to Elxis 4.x"

We are on the process of creating an non-official tool to transfer the content from Elxis 2009.x to Elxis 4.x

OK, we cannot update but can we use the old database and go with a new installation?

Officially Elxis 2009.x can not be updated to 4.x. You can not use a 2009.x database to 4.x.
This is the official state.
Unofficially everything can be done with hard work and caution.
If a developer wants and is able to do so (don't ask me how) he can transfer a 2009.x site to Elxis 4.x with a lot of work.
I personally advise you not to even try this because I am 200% sure that you will do it wrong.
My suggestion is this
Make a clean Elxis 4.x installation locally (or online if you don't have a local server).
Create categories/sub-categories as you had sections/categories on Elxis 2009.x.
For each article copy the HTML code from the editor of 2009.x and paste it into 4.x.
Transfer images and fix their paths where needed.
2009.x Bots should be removed and replaced by 4.x plugins where possible.
Third party components, weblinks, galleries, contact, etc, should be re-created with Elxis 4.x built-in or third party extensions.
Note that user access, menus, etc, are totally different in Elxis 4.x. So you have to re-create these things. You must be VERY careful.
When ready backup and transfer the local 4.x installation online.
